Electronic Cigarette Law & Public Health Information in New Delhi
An informational guide to India's electronic-cigarette restrictions and public-health resources for residents of New Delhi. The national restrictions apply here as elsewhere in India; city names do not create an exemption. This article provides general legal and health information, not an assessment or endorsement of products listed elsewhere on this website.
Important legal notice
India's Prohibition of Electronic Cigarettes Act, 2019 applies throughout India. Section 4 prohibits production, manufacture, import, export, transport, sale, distribution and advertising of electronic cigarettes, including covered components. Section 5 separately prohibits storage. These restrictions should not be read as a blanket statement that individual possession for personal use is an offence. Read the official provisions and seek qualified legal advice for a specific situation.
Which devices does the Act cover?
The Act's definition includes electronic nicotine delivery systems, heat-not-burn products, e-hookahs and similar devices, whether or not they contain nicotine. It excludes products licensed under the Drugs and Cosmetics Act, 1940. A brand name, nicotine-free label or online listing does not establish whether a particular product is legally exempt.
Official legislationWhat residents of New Delhi should know
The national law applies across India, including New Delhi. City names do not create an exception to the Act. If you are unsure whether a product or activity falls within the law, verify the current official text and seek qualified legal guidance.
Aerosol, nicotine and health
E-cigarettes heat liquid to produce an aerosol for inhalation, not harmless water vapour. WHO states that emissions typically contain nicotine and other toxic substances that can harm users and people exposed second-hand. Nicotine is highly addictive. Products may contain nicotine or be sold as nicotine-free; neither description establishes safety. Long-term health effects are not yet fully understood.
For personal advice or help with nicotine dependence, speak to a qualified healthcare professional. Product descriptions and testimonials are not medical advice.
